How to Change Your Name (after divorce)

Changing your name after a divorce typically involves a legal process that varies depending on your jurisdiction. Here are general steps you might follow, but keep in mind that the specific requirements can vary by location:

1. Finalize the divorce

Make sure that your lawyer includes a provision for your name change in the divorce decree.  It could say something like this:

Notice is hereby given that Plaintiff in the above matter, [you], hereby elects to retake and hereafter use [your new name] and gives this written notice avowing [pronoun] intention in accordance with the provisions of [legal reference].

If you don’t have this clause, you’ll need to file a petition for name change with your local court.

2. Obtain at least one Certified Copy of the Divorce Decree

Request one or more Certified Copy of the Divorce Decree, from your lawyer or by contacting the court that issued the decree.

3. Update Social Security & Driver's License

Begin with Social Security and Driver's License as these new IDs will likely be required for subsequent changes:

☑️ Social Security Card: Visit your local Social Security Administration office and complete the necessary forms to change your name on your Social Security card. You'll likely need to provide the certified copy of your divorce decree along with other identification.

 

☑️ Driver's License or ID Card: Visit the local Department of Motor Vehicles (DMV) or relevant agency to update your driver's license or identification card. Bring the certified copy of your divorce decree and any other required documentation.

4. Update Other Identification and Records:

Update your name with other important institutions.  You will likely need to provide your new Social Security card, Driver’s License and/or Divorce Decree

☑️ Banks

☑️ Employers

☑️ Insurance companies (health, homeowner/renter, auto, life, etc) Change your beneficiary if you haven’t already

☑️ Voter registration

☑️ Organizations where you hold accounts or memberships (gym, clubs, etc)

☑️ Professional licenses and associations

☑️ Post office (USPS)

☑️ IRS & State filing

☑️ Credit cards and credit reports (delete spouse’s name if present)

☑️ Library cards

5. Update Financial & Legal Documents

☑️ Will (update beneficiary and medical Power or Attorney if not already changed)

☑️ Financial accounts

☑️ Property deeds

☑️ Vehicle titles

☑️ Any other legal documents that reference your previous name.

6. Notify Utility Companies & Service Providers

☑️ Electric, water, sewer, etc

☑️ Doctors and other health care providers

☑️ Schools – yours and/or your children’s

☑️ Cable and cell phone providers
